TERMS AND CONDITIONS

Proofs and Completion of Photos: “LMG Photography” will have edited, and finalized photographs and delivered to client within 2 weeks of event. “Completed digital file(s) will be sent via email or online gallery. Online gallery will be available for 30 days. In the event “Client/Organization" fails to download digital images prior to deactivation of gallery, a $50.00 re-upload charge will apply in order to have images re-uploaded to gallery. “Clients/Organizations” requesting completed photos via memory card or flash drive will be charged an “additional fee” depending on the required gigabytes. “LMG Photography” DOES NOT accept external memory storage devices. No unedited photos will be released under any circumstances. Professional prints will be an additional fee. A 50.00 expedited fee is included with this contract, if client requests edited photos prior to 2-week promise of delivery of images. All images will be archived with LMG Photography for 12 months after photo session, then discarded.

 

Deposit/Refunds: All deposits/retainers are “non-refundable.” Clients may select a new date if photo-shoot/event is cancelled within 24 hours of the scheduled photo-shoot/event. “LMG Photography” reserves the right to charge a $50 loss of services/rescheduling fee.  If the “LMG Photography” fails to appear, the “Client/Organizations” full deposit will be returned within 3 business days.

 

Target Shots: In order to capture each moment, and every detail of your event, it is important that our “Clients/Organizations” (when possible) assign a photo assistant. This person should be knowledgeable of all the details of your event, including order of services, special guests, dignitaries etc. so that they can point out these guests to make sure we capture their photos.

 

Client’s Assistance: The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at the Photographer’s discretion; providing a person to guide the Photographer to desired persons and/or scenes; pre-shoot consultations, etc.  The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation.

 

Overtime/Tardiness: If your session/event goes over scheduled time, you will be charged and additional $50.00 per 15 minutes over the time that was scheduled and agreed to at the time of the signing of the contract. The Photographer will not be responsible for lost time due to lateness on behalf of the client. The Photographer will try her best to get amount of photos agreed at the signing of the contract. Overtime rate will apply if session goes beyond scheduled time.

 

Copyrights and Use: Title (possession) of and copyright to all products shall remain with the Photographer until the client has paid in full. All photos are copyrighted. The negatives and or digital images (hereinafter collectively the “images”) created by the Photographer and/or subcontractor(s) remain the property of the Photographer. It is illegal to copy, scan or alter images without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties. Photographs for Promotional Use: Permission is hereby granted to the Photographer to use any images created under this contract for professional samples, displays, Internet, web pages, advertising, exhibitions, contests, and any other purpose, but will receive approval from client in order to comply with client’s company brand marketing standards.. 

 

The Photographer retains the copyright to all images produced by the Photographer and/or the Photographers subcontractors. If purchasing Hi-Resolution images on CD/DVD, flash drive (thumb drive) or electronically, Clients must request a written release prior to making personal copies of images from CDs,DVDs,flash drive or electronically. The Client understands the images given on CDs,DVDs,flash drive or electronically cannot be used for profit. All posting of images on the Internet must be acknowledged as images by the Photographer.

 

Choice of Law: The laws of the County of Hartford in the State of Connecticut and any applicable Federal law shall govern this Photography contract.
